The grounds for the decision were a policy of restraint in relation to crimes where the issue is one of freedom of speech. This was despite the contents of the video.
Attorney general Eliyakim Rubinstein and State Attorney Edna Arbel have decided not to order the opening of an investigation into the video distributed by Shas chairman MK Arieh Deri. This position also reflects that of the head of the police Investigations Division, and was arrived at after the video cassette was viewed.
Rubinstein and Arbel decided there were no grounds for an investigation in the light of the video’s content and the policy of restraint in relation to crimes where the issue is one of freedom of speech. They said, "The attempt to delegitimize the system will not succeed. The State Attorney’s Office will have its say in the Supreme Court, if and when an appeal (against Deri’s conviction on bribery charges) is filed."
