Given Imaging alleges that the employee filed patent applications covering technologies that it developed.
Israeli medical device maker Given Imaging (Nasdaq: GIVN) announced today that it had initiated legal action at the Haifa District Court against Doron Adler, a former employee, and two companies which he founded, CByond, Inc. and CByond Ltd.
Given Imaging alleged that Adler and the companies he founded made improper use of technology developed at Given Imaging, and also filed patent applications covering those technologies.
Given Imaging said in a statement it was seeking a preliminary injunction to prevent Adler and CByond from transferring this technology and to require the return of the patent applications to Given Imaging.
Given Imaging, which develops a camera-in-pill device for endoscopy of the small intestine, said the technology in question was not currently used in any of its products and to its knowledge was not being used to develop similar products by Adler or his companies. But at the same time, the company said it must vigorously protect its intellectual property rights and ensure that present and former employees comply with all of their legal and contractual obligations to the company.
