Oridion faces US lawsuit over breath test system

The patent infringement suit relates only to Oridion’s BreathID H. pylori breath test in the US.

Jerusalem-based Oridion Systems (SWX Main Market: ORIDN), a developer of patient safety monitoring products, announced today that it had been sued for patent infringement in the United States.

The suit was brought before the United States District Court for the District of Massachusetts by Meretek Diagnostics, Inc. and Medquest PTY., Ltd. charging that the Oridion BreathID H. pylori breath test system infringed United States patent no. 4,830,010.

The suit relates only to Oridion’s BreathID H. pylori breath test in the US, Oridion says.

According to the lawsuit Medquest claims to own the patent and Meretek claims to hold an exclusive license under the patent. The suit does not relate to the sale of Oridion’s H. pylori breath test in any other country, and it also does not relate to the sale of the BreathID in the US with any other of the BreathID diagnostic breath testing applications, the company says.

Meretek and Medquest have requested that the court enter a preliminary injunction prohibiting importation, sale, offer for sale and use of the Oridion H. pylori breath test in the United States pending the lawsuit. No hearing date has been set. Oridion says it has good defenses and intends to vigorously defend its position in this litigation.

The company does not expect the outcome of such matters to have a material adverse effect upon its business and financial condition, results of operations and cash flows.

The BreathID is an office-based multi breath test system that enables physicians to test, obtain results and begin treatment in a single patient visit.
